Much Ado About Alito

Before the uproar over Alito's 1985 position concerning whether the right to an abortion is protected by the Constitution grows too deafening, let's pause to consider their relevance to his qualifications as a Supreme Court Justice and how they compare to stated positions of other Justices.

The Judicial Confirmation Network and the American Center for Law and Justice have both issued releases plainly stating that the comments are inappropriate grounds to vote down a nominee. Not only have prior nominees (e.g. Ginsburg and Breyer) publicly stated opposing viewpoints without rebuke prior to their confirmations, but the position in question, it should be noted, does not comment on the question of abortion itself, but rather on its identity as a Constitutional matter. In this, Alito's record represents a very mainstream opinion.

Abortion is the only issue that matters to those who lead the Democratic Party around by the nose.

In Colorado, the Republican governor is not allowed to run for re-election. The Dems have a narly unbeatable candidate--I say "nearly" just because there is some faint possibilty that the GOP might find a really amazing person to run against him.

But the Dems are looking for someone else---because this highly qualified, extremely popular, slam-dunk candidate is pro-life.

And let's face it---the ardent support of the ability for women to scrape their children out of their wombs is really all that matters.

Just as all that matters for any Supreme Court nominee is a willingess (or eagerness) to find and follow that emanation of that penumbra that led to the discovery of a constitutional right to kill inconvenient children if they are of a certain age.
