Bush Reins in Eminent Domain

This is a good move.

By the authority vested in me as President by the Constitution and the laws of the United States of America, and to strengthen the rights of the American people against the taking of their private property, it is hereby ordered as follows:

Section 1. Policy. It is the policy of the United States to protect the rights of Americans to their private property, including by limiting the taking of private property by the Federal Government to situations in which the taking is for public use, with just compensation, and for the purpose of benefiting the general public and not merely for the purpose of advancing the economic interest of private parties to be given ownership or use of the property taken...

President Bush's executive order concerning property rights is a cruel hoax on everyone being threatened with eminent domain, even more insulting is that he did so on the anniversary of Kelo. About 6000 people have been threatened with eminent domain in the last year and none were threatened by the Federal Government. President Bush could have easily included language in his executive order that would have denied funds for 2 years to cities and states that abuse eminent domain. Such language is included in HR4128 which the House passed last year with 90% voting in favor. HR4128 has been stuck in the Senate Judiciary since late last year, and Senator Specter and President Bush are doing nothing to advance it. Once again President Bush thinks we are all stupid. I am one Republican that will sit out the elections in 2006 & 2008 unless HR4128 in its current form becomes law, or better yet, if President Bush issues a new executive order that is meaningful.

Well, what a relief! Am I ever glad that I won't lose my property to a federal eminent domain claim that doesn't benefit the public. Thank you Mister President!!

...now if you'd just mind getting to work on those little matters of the warrantless wiretapping, shipping people off to secret foreign prisons without trial or legal representation, dodging congressional and judicial review, holding people under arrest indefinitely without charge or trial, monitoring international bank transactions without warrants, frivioulous FBI investigations, and the USA-PATRIOT Act; we can start thinking about getting America back on track to being the *real* "Land of The Free".

Private property is pointless without personal privacy.
